yesterday the country was awaken by the news of the bar council anjurkan forum memeluk islam.hm..i mean they have the issue, but cara the BC buat tu cam x patut.i, as a law student understand the issues pertaining this forum, but the way it is done is just not right.
i mean yeah, there are problems that arise throughout the years on the issue of conversion and custody of the children when the parents decides to convert to islam. i, as a muslim understand the limits and boundries that is within our religion. i mean, xkan kita nak biar senang2 je kan org murtad? but, it is now the work of the legislators. mase dorg nak draft law, they have to think the pros and cons of every aspect of the problem. when things becomes confusing, mase ni la golongan2 yg rase dorg ni btol come in and try to rationalize. do you get what i mean?
ok...let me recap for those yg have no legal background. there is an issue about syariah courts and the civil courts as long as i can remember. cases are kicked back and forth because lack of jurisdiction. then come article 121A whereby it states that the civil courts does not have the jurisdiction to hear cases that falls under the jurisdiction of the syariah courts. but...we must remember that the power of the syariah court is only on the muslims and non muslims are not under the jurisdiction of the syariah courts.
this is where the problem arise...
when only one of the spouse convert to islam, how can we impose judgement onto the other spouse who did not convert? and also, under islamic law, the marriage will automatically break down when one of the spouse converted to islam.but, under the civil law, it does not work the same way. in civil law, the non-convert spouse have the power whether to dissolve the marriage or not. that is one of the problem
next...when non-muslims goes to the syariah courts in regards of the custody of their children, they are not bound by it.so u see? even though article 121A is suppose to provide separate powers on syariah and civil courts, there is still an overlap. also, our authorities does not have the initiative to implement all the things possible in order for them to track down and register all the people who had converted to islam. this is where another problem arise when the authorities have no record of the conversion and then when that person dies, he will be buried by hindu rights and not done according to islam.
there are also lots of issue that arise where i think is too much for me to type.if nak tahu dtg la jumpa i so i can plain it personally to u guys.
basically, the bar council is just trying to search for a way to solve this problem.but the way they have done it angers the muslims. they should not have done things that would bring out sensitive issues. this will cause disharmony and suppose the government should charge them under ISA because they have cause disharmony and have in a way have encroach the security of the country
so basically, i think if the BC wants to do a forum as they have done yesterday, they should have done it secara tertutup and not the way they have done yesterday. ok guys? comon la...and lagi satu, we are looking at it in a different perception as the bar council...so, maybe dorg x terpikir org islam akan marah camtu skali..neway..i think malaysia skarang dah kucar kacir..really hate it!
